Heroin charges can come with steep penalties in Georgia

Athens, Georgia, is an interesting town. You may have grown up in the area or moved here after acceptance to the University of Georgia. Whatever the case, you consider it your town. You may have favorite restaurants and hangouts and made many memories while attending the university. Of course, not everything is fun all the time.

You may have found yourself in a difficult spot in life and tangled up in some unseemly activity. In particular, authorities may suspect that you had involvement in some type of drug crime. If they suspect that you had heroin in your possession, you could face the risk of serious penalties if convicted of charges in court.

Strict heroin laws

The state has strict laws regarding heroin, and possession of any amount of the substance is considered a felony. In fact, possession of 4 grams or more could result in a maximum of 15 years in prison for a first offense if convicted. Even if you do not face the maximum punishment, a minimum sentence is two years behind bars. If this is not your first offense, the possible penalties become more severe with a minimum jail time of five years and a maximum of 30 years if convicted.

If authorities suspect you of more than just possession, the penalties increase further. For example, selling heroin could result in a minimum of five years in prison and a maximum of 30 years, even for a first offense. It is possible for someone to face life in prison for a subsequent offense of selling heroin in the state. Selling the substance is more serious than possessing it because it enables drug users and could lead to more people using the substance.

What can you do?

Undoubtedly, you do not want to face years in jail for heroin possession. Because the charges are so serious, you may worry that you are out of luck from the beginning. Fortunately, that is not the case. You have the right to defend against any criminal charge brought against you, and building a meaningful defense presentation could allow you to work toward favorable outcomes.

You may not feel confident in your abilities to create a strong defense, but luckily, you do not have to tackle such an endeavor on your own. An experienced defense attorney could help you address your case and find the most viable options for your defense.
