What are attractive nuisances?

On Behalf of | Jun 27, 2025 | Premises Liability

Some properties contain features that seem fun or interesting to children but are quite dangerous. These are known as attractive nuisances. They can pose serious risks, especially when children wander onto private property out of curiosity.

An attractive nuisance is something on a property that might tempt children to explore, even if they do not understand the danger. While adults may see the risks, children may not. This is why property owners must take reasonable steps to secure these hazards.

Common examples of attractive nuisances

Attractive nuisances can take many forms. Some of the most common include:

  • Swimming pools or hot tubs

  • Abandoned vehicles or machinery

  • Construction sites

  • Trampolines or playground equipment

  • Open wells or pits

These items often catch a child’s attention. A brightly colored toy, an empty pool or an unlocked shed may not seem threatening, but they can quickly lead to injury if left unattended or unsecured.

Why they are dangerous to children

Children are naturally curious. They might climb a fence, squeeze through a gap or simply walk onto a property to get a closer look. However, once inside, they may not know how to stay safe. For example, a child could fall into a pool, get trapped in an old refrigerator or get hurt using unsafe tools or equipment.

Property owners may be held responsible if a child is injured by an attractive nuisance on their land. This is especially true if the hazard was not secured or if the owner knew children might try to access it. While each situation is different, courts often consider whether the danger was obvious and if steps could have been taken to prevent harm. If your child has been injured, you should seek legal guidance.
